Planning applications and appeals privacy notice

Privacy notice specifically for planning applications made by agents and the public.

This privacy notice explains:

  • how personal information is going to be used
  • what it is used for
  • who it might be shared with and why
  • how long it is kept.

The information you provide helps us deliver our services effectively.

Data Controller

West Sussex County Council (WSCC) complies with the Data Protection Act and the UK General Data Protection Regulation (UK GDPR). It is registered as a ‘Data Controller’ with the Information Commissioner’s Office (Reg. No. Z6413427).

We ensure that your personal data is processed fairly and lawfully, is accurate, kept secure and retained for no longer than is necessary.

The legal basis for processing personal data

In processing data submitted as part of the planning process, the County Council is performing a ‘public task’ by way of its statutory function as a local planning authority under the Town and Country Planning Act 1990 (as amended).

How we use your personal information

Applicants and agents

West Sussex County Council (WSCC) must publish online a list of planning applications and associated details. This will usually include the name and address of the applicant, their agent (where applicable) and the name and contact details of the landowner.

These details will be retained and available online indefinitely.

Members of the public commenting on planning applications

WSCC will redact signatures, email addresses and phone numbers included in public comments, but will display names and addresses if provided.

Names and addresses are important for transparency and for officers to understand where identified issues will be experienced and/or features located. Please do not include this information if you do not wish it to be made public.

Once the application has been decided, these details will be retained online and the in-house planning register for a period of four years.

Consultees (statutory bodies and other organisations)

WSCC will publish your comments on its website without redaction. Please do not include any information you do not wish to be made public.

We will retain these details and keep them available online for a period of seven years.

If you have found information online that you wish to have removed please email: planning.applications@westsussex.gov.uk.

Who we share your information with

As and when an appeal is submitted and processed (for example, against the refusal of planning permission or the serving of an enforcement notice), WSCC will share the following information with the Planning Inspectorate (PINS), which is registered as a ‘Data Controller’ with the Information Commissioner’s Office (Reg. No. Z7123035):

  • Names
  • Addresses
  • Contact details (including email addresses and phone numbers)
  • Personal contained in submissions and representations.

The data will be shared so that WSCC and PINS can perform their statutory duties and to enable them to deliver services to their respective stakeholders.

Pre-application advice

We will not display pre-application advice online. We will, however, retain pre-application advice requests and responses for a period of seven years, after which the information will be deleted.
