Roles and responsibilities

County Council
As the minerals and waste planning authority, we are responsible
for determining planning applications for mineral and waste
development and for the County Council’s own development, such as
new roads and schools (also known as ‘Regulation 3’
applications). We are also responsible for ensuring compliance
with planning conditions attached to planning permissions.
The County Council, however, cannot take legal action against
itself. If a breach of planning control concerns development
by the Authority itself, the matter should be resolved through
internal procedures and sanctions. For serious breaches of
planning control, the case may be referred to the relevant district
or borough council for formal enforcement action to be taken
against the County Council.
In addition to the powers available to us, there are other bodies
that have regulatory powers and responsibilities, primarily the
district and borough councils (both planning and environmental
health) and the Environment Agency. We will continue to work
with these organisations to secure efficient remedies to any
breaches in planning or other controls.

District and borough councils
The district and borough councils in West Sussex deal with all
other planning matters, including compliance and enforcement
matters for following:
- developments permitted by the relevant district/borough council
or unauthorised developments that require planning permission from
them; and
- sites involving multiple breaches of planning control including
breaches relating to waste development.
The district and borough councils are also responsible for dealing
with abandoned vehicles and flytipping. For further

Environment Agency
In addition to planning permission, many waste operations
require an environmental permit (formerly a waste management
licence or pollution prevention control consent) from the
Environment Agency (EA).
Although the enforcement of waste licensing issues is,
therefore, a matter for the EA, we will liaise closely with them on
waste-related matters.

Health and Safety Executive
The Health and Safety Executive (HSE) work to protect people
against risks to health or safety arising out of work
activities.
The enforcement of legislation relating to health and safety is
the responsibility of the HSE and we will liaise closely with them
on such matters at mineral and waste sites.
